EMDR ACADEMY SERVICE AND TRAINING REGULATIONS

§1. General Provisions

  1. This Regulation defines: 
    • terms of use for the EMDR Academy website ("the Website"), 
    • rules for registration and participation in training courses, webinars, courses, workshops, and other educational events, 
    • rules for the sale of electronic services and digital content, 
    • payment, complaint, and contract withdrawal terms. 
  2. The Website serves informational and sales purposes. Through it, the Organizer presents: 
    • an offer of training and courses for therapists and specialists, 
    • educational and organizational materials, 
    • online and in-person events, 
    • the option to subscribe to the newsletter, 
    • the option to purchase access to digital content, recordings, and VOD materials. 
  3. The owner of the Website and the organizer of training courses is:

  1. Use of the Service signifies acceptance of these Regulations.

  • Organizer / SellerOrganizer / Seller – Sylwia Mańka, conducting business as specified in §1. 
  • ParticipantParticipant – an individual registering for training or using the Organizer's services. 
  • TrainingTraining – an online or in-person training, webinar, workshop, course, or other educational event. 
  • Digital ContentDigital Content – electronic materials, recordings, audio/video files, VOD courses, e-books, and other materials made available online. 
  • ServiceService – the EMDR Academy website. 
  • External PlatformExternal Platform – a system used for registration, sales, event organization, payments, or communication with Participants (e.g., Conrego, webinar platforms, mailing systems, VOD platforms).

§3. Technical Requirements§3. Technical Requirements

  1. To use the Service and its offerings, the following are required: 
    • a device with Internet access, 
    • an up-to-date web browser, 
    • an active email address. 
  2. For online training or VOD content, the following may be required: 
    • an account on an external training platform, 
    • a device capable of audio/video playback. 
  3. The Organizer is not responsible for technical problems resulting from: 
    • improper configuration of the Participant's device, 
    • issues on the part of the internet service provider, 
    • actions of external platforms independent of the Organizer.

§4. Training Registration§4. Training Registration

  1. Registration for training courses may occur: 
    • through forms available on the Website, 
    • via external platforms supporting events and payments (including Conrego or other providers). 
  2. Effective registration may be conditional upon: 
    • provision of required data, 
    • acceptance of the Terms and Conditions and Privacy Policy, 
    • payment, 
    • fulfillment of qualification requirements specified in the training description. 
  3. For training courses requiring prior preparation, the Organizer may request: 
    • information about completed training courses, 
    • documents confirming qualifications, 
    • submission of certificates of completion for previous training levels. 
  4. The Organizer processes only the data necessary to verify compliance with participation conditions. 
  5. The Organizer reserves the right to refuse participation in the training to individuals who do not meet the substantive or organizational requirements.

§5. Payments§5. Payments

  1. Participation in training and access to digital content may be subject to a fee. 
  2. Payments can be made: 
    • by bank transfer, 
    • via online payment operators, 
    • by payment card, 
    • through payment systems integrated with registration platforms. 
  3. Prices are quoted in Polish zlotys and include VAT information in accordance with applicable regulations. 
  4. Payment is considered complete when the Organizer's account is credited or confirmation is received from the payment operator.

§5a. Funding for Training from External Sources§5a. Funding for Training from External Sources

  1. The Participant may apply for training funding from external sources, including, but not limited to, loans, grants, or education support programs. 
  2. The Organizer may – at their discretion – agree to defer the payment deadline for the training until the Participant receives a decision on funding approval. 
  3. Payment deferral requires the Organizer's prior consent, expressed at least in documentary or email form. 
  4. The maximum payment deferral period is 30 days from the date the Participant completes the training, unless the Organizer decides otherwise. 
  5. In the event of: 
    • failure to obtain funding, 
    • refusal to grant funding, 
    • leaving the application unexamined, 
    • the Participant's resignation from applying for funding,
      The Participant is obliged to: 
    • immediately inform the Organizer of this fact, 
    • make full payment for the training within 7 days from the date of receiving the decision or becoming aware of the lack of funding. 
  6. Failure to obtain external funding does not release the Participant from the obligation to pay for the training. 
  7. The Organizer may condition the Participant's involvement in the training on the submission of documents confirming the application for funding.

§6. Provision of Services and Digital Content§6. Provision of Services and Digital Content

  1. Access to online training, webinars, or digital materials is provided: 
    • by email, 
    • via the user account, 
    • via a link to the training platform, 
    • via a VOD or webinar platform. 
  2. The Organizer may provide: 
    • training recordings, 
    • educational materials, 
    • temporary access to digital content. 
  3. The Organizer reserves the right to limit temporary access to materials or recordings as described in the offer. 
  4. The Participant may not: 
    • provide access to third parties, 
    • copy or distribute materials, 
    • record training sessions without the Organizer's consent.

§7. Change of Date or Cancellation of Training§7. Change of Date or Cancellation of Training

  1. The Organizer reserves the right to: 
    • changes to the training date, 
    • changes to the instructor, 
    • changes to the program that do not negatively affect the nature of the training, 
    • cancellation of the training due to organizational, technical, or unforeseen reasons beyond the Organizer's control. 
  2. In case of training cancellation, the Organizer will: 
    • will refund the fee paid, or 
    • will offer participation at a different date. 
  3. The Organizer is not liable for indirect costs incurred by the Participant.

§8. Recording of Training Sessions§8. Recording of Training Sessions

  1. Online training sessions may be recorded: 
    • for archiving purposes, 
    • for providing access to participants, 
    • for the delivery of VOD content, 
    • to ensure service quality. 
  2. Participants will be informed about recording before the event begins. 
  3. The Participant agrees not to record or disseminate the training content without the Organizer's consent. 

§9. Invoices§9. Invoices

  1. Upon the Participant's request, the Organizer issues a VAT invoice. 
  2. Billing information should be provided during registration or before making payment. 
  3. The Participant agrees to receive electronic invoices.

§10. Withdrawal from the contract§10. Withdrawal from the contract

  1. The consumer has the right to withdraw from a distance contract within 14 days from the date of its conclusion, unless an exception provided by law applies. 
  2. For services: 
    • provided within a specified period, 
    • access to digital content, 
    • online training courses commenced with the Participant's consent,
      the right of withdrawal may not apply in accordance with Article 38 of the Consumer Rights Act. 
  3. The Participant acknowledges that consenting to the commencement of service provision before the withdrawal period expires may result in the loss of the right to withdraw from the contract.

§11. Complaints§11. Complaints

  1. Complaints regarding the Service or services can be submitted: 
    • by email to: hello@akademiaemdr.eu, 
    • in writing to the Organizer's address. 
  2. The complaint should include: 
    • participant's details, 
    • description of the problem, 
    • the participant's request. 
  3. The Organizer will process the complaint within 14 days.

§12. Copyright§12. Copyright

  1. All materials, recordings, educational content, graphics, and documents made available by the Organizer are subject to legal protection. 
  2. Without the Organizer's prior consent, it is prohibited to: 
    • copying, 
    • distributing, 
    • making available, 
    • publishing, 
    • commercial use of materials.

§13. Liability§13. Liability

  1. The Organizer exercises due diligence to ensure the Website operates correctly. 
  2. The Organizer does not guarantee uninterrupted availability of the Website or external platforms. 
  3. The Organizer is not responsible for: 
    • technical problems on the Participant's side, 
    • consequences of providing incorrect data, 
    • actions of third parties, 
    • use of the Website in a manner inconsistent with the Regulations.

§14. Final Provisions§14. Final Provisions

  1. The Regulations are governed by Polish law. 
  2. The Organizer may amend the Regulations for valid legal, technical, or organizational reasons. 
  3. The current version of the Regulations is published on the Website.
